Welcome to FormatPort. These Terms of Service ("Terms") govern your access to and use of the FormatPort mobile and desktop application (the "Service"), operated by Kaka Inc. ("we", "us", or "our").

By installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service and Local Processing

FormatPort is a file conversion utility designed to change files from one format to another (e.g., video to audio, document conversion).

• Local Operation: The Service operates entirely locally on your device. All file processing occurs on your device. We do not transmit or store your files on our servers.
• User Responsibility: You are solely responsible for the content of the files you process and ensuring you have the necessary rights, licenses, and permissions to convert, distribute, or use such content.

2. Subscription and Premium Features

The Service may be offered on a "freemium" model.

• Free Version: The free version of the App may have limitations, including but not limited to usage quotas (number of conversions per day), file size restrictions, or feature limitations.
• Premium Features: You may purchase access to premium features to unlock full functionality and remove usage restrictions.
• In-App Purchases: All purchases for premium features are handled through Apple's App Store ("In-App Purchases"). Your relationship regarding these purchases is governed by Apple's Terms and Conditions.

3. Intellectual Property

• App Content: All content within the App, including text, graphics, logos, and the software itself, is the property of Kaka Inc. and protected by international copyright and intellectual property laws.
• User Content: We do not claim ownership of the files you process using the Service.

4. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranty of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Kaka Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Service. Because the Service operates locally, we are not responsible for any data loss, file corruption, or device malfunction that occurs during the conversion process.

6. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Effective Date" or through a notification within the App. Continued use of the Service following the posting of changes means you accept the updated Terms.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of China, without regard to its conflict of law provisions.
